CHARTER AND BY LAWS

OF THE

PARTIDONG PANDAIGDIGANG PILIPINO

PREAMBLE

We, the Overseas Filipinos Worldwide (OFW), together with our families and friends at home and elsewhere in the world, united in common purpose, hereby dedicate ourselves to the principles and values that guided our forefathers in their quest for a truly independent and democratic Philippines.

 

We recognize that the Nation’s political as well as economic stability is founded on the strength of its political institutions. We acknowledge that a political party which seeks the trust of the people must prove that it is worthy of that trust; that a party which professes that the Constitution reflects the Sovereign Will of the people must be ready to uphold it at all time; that a party which aims to achieve the best for the Nation and its people must embody our Nation’s heritage and traditions.

 

Upon these principles, we shall endeavor to be the prime mover of ethical governance and corrupt-free government; to be the Party of choice by all those who believe in the teachings, ideals, and principles of our forefathers and national heroes

 

We pledge ourselves to serve the Filipino people with the highest degree of dignity, excellence and equality by abiding strictly to the tenets of accountability, transparency, integrity, and credibility and by seeking Divine Guidance in our manners and ethics.

 

Under God’s guidance, we do establish and adopt this Charter of the Partidong Pandaigdigang Pilipino.

 

ARTICLE I

NAME AND DOMICILE

 

SECTION 1 – The name of this Party shall be “PARTIDONG PANDAIGDIGANG PILIPINO” and its acronym shall be “PPP”, hereinafter referred to as the “Party” or “Partido”.

 

SECTION 2 – The domicile of the national headquarters of the PPP shall be in _________________________Metro Manila, Philippines. The National Executive Council may establish additional headquarters, offices, chapters and affiliates in the Philippines, and elsewhere in the world as it may deem proper and appropriate in order to attain the objectives of the Party.

 

ARTICLE II

 PLATFORM OF GOVERNMENT

 

We believe that government must work to build and defend a strong nation; promote the equitable distribution of wealth; develop and conserve our human resources; protect and preserve the environment and our natural wealth; promote equal opportunity, the advancement of science, commerce and industry; and ensure equal protection of every Filipino’s rights, property, and life.

 

We, the Partidong Pandaigdigang Pilipino, will therefore work to achieve a society,

  • Where love and respect for our country – the Philippines, the Filipino people and God are our highest obligations;
  • Where respect for life and human rights is a basic value of our governance;
  • Where unity, freedom and principles of democracy are upheld by everyone;
  • Where we recognize that the strengthening of the family and the protection of children are essential in the building of a strong nation;
  • Where all able bodied Filipinos can find jobs in a growing full employment economy, rather leave the country to work in a foreign land;
  • Where workers are guaranteed the legal right to join unions of their choice, and to bargain collectively for decent wages and working conditions;
  • Where the livelihood of our families in the rural areas are as stable as the values they instill on their children;
  • Where the equal rights of women are guaranteed in the Constitution;
  • Where the rights of the minorities are fully secured, and where no one is denied the opportunity for a better life;
  • Where the elderly and disabled can lead lives with dignity and where Social Security remains a public commitment;
  • Where public and private discrimination of all types are condemned and where our government acts decisively and aggressively to end such discrimination by lawful means; and,
  • Where sound education, quality medical care, affordable housing, healthy environment, and safe streets, cities, and countryside are possible for every Filipino.

 

ARTICLE III

PARTY OBJECTIVES

 

The Partidong Pandaigdigang Pilipino (PPP) shall:

SECTION 1 – Nominate and assist in the election of party candidates for the offices of the President, Vice President and members of the Senate.

 

SECTION 2 – Assist the local Party Organizations in the election of their candidates, as well as in the political education of their voters.

 

SECTION 3 – Advocate, adopt, and promote policy statements and programs related, but not limited, to electoral reforms, overseas Filipino workers welfare and protection, and labor.

 

SECTION 4 – Establish rules of procedure that will allow equal opportunity for members to participate in decisions concerning the selection of candidates, formulation of policies, and conduct of Party affairs.

 

 

SECTION 5 – Work with Party public officials at all levels to achieve the objectives of the Party.

 

SECTION 6 – Advocate and/or legislate such programs for the welfare of Overseas Filipinos, like:

6.1.Advocate for the safety and well being of the OFs.

6.2.  Promote civic, social and economic programs designed for the upliftment of OFs.          

6.3.  Advocate for the implementation of a social security systems designed to meet the needs and requirements of OFs.

6.4.  Advocate for the national Policy and program for crisis intervention on the plight of OFs in distress in various parts of the world.

6.5.  Advocate for the national policy and program for the re-integration of OFs into the mainstream of Philippine economy and society;

6.6.  Legislate laws to safeguard OFs from illegal and exploitative recruitment practices, and enact a law that will provide stiff punishment;

6.7.  Legislate laws that will provide stiff punishment to proven corrupt officials in the POEA, OWWA, DOLE and other government agencies mandated to take care of the plight of the OFWs.

6.8.  Advocate for upholding the Human Rights of OFs all over the world, and urge the Philippine Government to exert more efforts through diplomatic channels to provide relief to OFs who have fallen victim to human rights abuses.

 

SECTION 7 – Raise and disburse funds needed for the successful operation of the Party.

 

SECTION 8 – Advocate, establish, and promote rules of ethical guidance that will ensure that government officials and employees shall at all times conduct themselves in a manner that reflects credibility of the office they serve.

ARTICLE IV

DEFINITION OF TERMS

SECTION 1 – For purposes of this Charter and By Laws, the following terms and/or acronyms are hereby defined:

1.1.  PPP shall mean the Partidong Pandaigdigang Pilipino

1.2.  Partido shall also mean the Partidong Pandaigdigang Pilipino

1.3.  Party shall also mean the Partidong Pandaigdigang Pilipino

1.4.  Pilipino(s) shall mean the same as Filipino(s)

1.5.  OF will mean Overseas Filipinos while

1.6.  OFW shall mean Overseas Filipinos Worldwide

1.7.  NEC is the acronym for National Executive Council

1.8.  NB is the acronym for the National Board

1.9.  REC is the acronym for Regional Executive Council

1.10.   PEC is the acronym for Provincial Executive Council

1.11.   DEC is the acronym for District Executive Council

ARTICLE V

MEMBERSHIP

SECTION 1- The Party shall be open to all Filipinos who believe in the vision, mission and core values of the Party, and willing to support its platform of government.

SECTION 2 – Discrimination in the acceptance of members and conduct of Party affairs on the basis of creed, religion, sex, age, ethnic origin, color, economic status, sexual orientation or physical disability shall be prohibited to ensure that the Party at all levels is an open party.

SECTION 3 – Application Procedures

An application for membership in the Party shall be submitted to the nearest Barangay or City/Municipal chapter of the applicant’s residence. The Chapter’s Membership and Credentials Committee shall have the authority to approve or disapprove all applications for membership.

SECTION 4 – Oath of Affiliation

New members of the Party shall first subscribe to the following oath of affiliation:

Having been accepted as member of the Partidong Pandaigdigang Pilipino do hereby solemnly swear  that I will bear true faith and allegiance to the same; that I will support and defend its Constitution and its Vision, Mission and Program of Government; that I will work for its victory in elections and for the realization of a free, just, democratic and progressive society with a government that is clean, honest and responsive to the needs of the People; that I will comply with such rules, regulations and decision as may be promulgated by the duly-constituted  Party authorities; and that I will serve the Partidong Pandaigdigang Pilipino faithfully without any mental reservation whatsoever.

SECTION 5 – Administering Oaths

Oaths of Affiliation may be administered by any of the executive officers of the Party Chapter to which the member is affiliated.

 

SECTION 6 – Equal Rights and Duties of Members

All members of the Party shall have equal rights and duties as follows:

6.1.  Be heard and to vote in Party meetings;

6.2.  Choose or be chosen as a Party official;

6.3.  Be informed of Party meetings, plans, activities, finances and the use of Party funds and property;

6.4.  Be accorded due process on complaints, investigations and decisions on matters affecting membership and tenure;

6.5.  Support and defend the Constitution

6.6.  Promote the Party Vision, Mission and Program of Government

6.7.  Be actively involved in Party meetings, activities programs and projects

6.8.  Pay dues and assessments, when required.

SECTION 7 – Grounds for Disciplinary Action 

Any member of the Party may be disciplined, suspended or removed from the Party on any of the following grounds:

7.1.     Participation in any act that are against the objectives or inimical to the interest of the Party, or for violation of or deliberate failure to support any of the Party’s fundamental decisions;

7.2.     Failure to attend three (3) consecutive Party meetings or at least 2/3 of the meetings duly convened within a given calendar year of the appropriate committee without valid reason duly communicated within a reasonable period prior to the meeting and subsequently approved by the appropriate committee;

7.3.     Non-participation in Party-sanctioned activities without valid reason duly communicated within a reasonable period prior to the activity and approved by the appropriate committee;

7.4.     Membership in another political party, either by act or deed;

7.5.     Committing the PPP, its chapters and organizations to actions, endorsements or other policy positions outside of the Party’s decision-making process;

7.6.     Misrepresenting the decisions or policies of the PPP;

7.7.     Financial irregularity with PPP and affiliates’ chapter/organization funds;

7.8.     Advocacy or practice of racial, sexual, national or religious oppression;

7.9.     Advocacy or practice of violent political action by the PPP member or any affiliated Chapter/organization;

7.10.  Acting as a strike-breaker, agent provocateur or government or corporate informer;

7.11.  Acting to willfully disrupt the freedom of speech, press or assembly of any individual or affiliated Chapter/organization of the PPP;

7.12. Continually failing to participate in a regular or special meeting at the unit level or affiliated local chapter/organization after receiving official written notice.

SECTION 8 – Procedure

The appropriate committee or Party organization may, motu propio or acting upon a complaint executed by any Party member, investigate and decide on the case whose decision may be appealed to the National Executive Council, whose decision(s) shall be final.

SECTION 9 – Resignation

A Member may resign at any time from the PPP and/or from any unit chapters upon submission of written notification.

SECTION 10 – Suspension

A Party member may be suspended for a period not exceeding one (1) year.

SECTION 11 – Reinstatement

A Party member duly removed may apply for reinstatement to the Party Rolls upon written application to the Membership and Credentials committee. Said member is deemed reinstated on the day the committee acts favorably on the matter by 2/3 votes of the committee members present, there being a quorum.

ARTICLE VI

SUPPORTERS AND PATRONS

SECTION 1 – The Party, at all levels, will welcome all support coming from individuals who are not Party members, as well as from corporate and non-government organizations, subject to the limitations provided by the electoral laws of the Philippines.

SECTION 2 – The Party administrative unit that received financial support for a specific project shall submit to the donor a report once the project is completed. Financial support for general purposes shall not require any special report to be submitted to the donor.

SECTION 3 – Financial support to the Party received from members, patrons, and other supporters shall be fully recorded and acknowledged by the treasurer of the administrative unit, subject to the limitations provided by the electoral laws of the Philippines.

ARTICLE VII

PARTY ADMINISTRATION

SECTION 1 – General Statement

The Party shall be administered by the following:

1.1.  At the National level, by the National Assembly of Members, the National Executive Council, and the National Executive Board;

1.2.  At the regional level, by the Regional Executive Council and Regional Executive Committee;

1.3.  At the provincial level, by the Provincial Executive Council and Provincial Executive Committee;

1.4.  At the district level, by the District Executive Council and District Executive Committee;

1.5.  At the municipal level, by the City or Municipal Executive Council, and where possible at the Barangay level, by the Barangay Executive Council

SECTION 2 – Where the Party Chapter is organized at the City/Municipal level, the administrative body will be composed of a Local Board and Executive Officers, and there will be no administrative body in the Barangay level.

 

SECTION 3 – The chapters that shall be created in the Central, Western, and Eastern regions of the Kingdom of Saudi Arabia, each of the other Gulf states, each of the European countries, each state of the USA, Canada, Australia, Hong Kong and other countries, shall be organized as regional chapters but shall be administered in the same manner as the City or Municipal chapters.

SECTION 4 – Autonomy and Interdependence

The Party’s administration, which shall be fashioned so that in the conduct of the affairs of the Party only the will of the members shall prevail, envisages autonomy in the various levels of the Party machinery, consistent with the interdependence necessary for the attainment of the objectives of the Party as provided for in this Charter and in accordance with such decisions as from time to time may be adopted by the National Assembly, the National executive Council and the National Executive Board.

ARTICLE VIII

THE NATIONAL ASSEMBLY

SECTION 1 – The Party shall assemble in a National Assembly of Members at least once every three years.

SECTION 2 – The National Assembly shall be the highest authority of the, subject to the provisions of this Charter. It shall recognize all Chapters of the Party entitled to participate in the national affairs of the Party including its conventions and conferences.

SECTION 3 – The National Assembly shall nominate the Party’s candidate for the office of the President of the Philippines, a candidate for the office of the Vice President, and the needed number of candidates for the Philippine Senate. It shall also adopt a platform, and act on such other matters it deems appropriate.

SECTION 4 – The National Assembly shall be composed of:

4.1.  The duly appointed delegate(s) from the provincial executive councils;

4.2.  The duly appointed delegate(s) from each chapter  outside the Philippines;

4.3.  The present and former Presidents and Vice Presidents of the Philippines, who belong to the Party;

4.4.  The present and former members of the Senate and House of Representatives who are PPP members;

4.5.  The present and former provincial governors who are PPP members;

4.6.  The present and former city or municipal mayors who are PPP members; and

4.7.  The former chairpersons of the National Executive Council.

SECTION 5 – The National Assembly vote allocation shall be consistent with the formula giving weight to voting population and Party membership in each chapter. It may also provide for additional votes from PPP public officials specifically defined in the Notice of Assembly, subject to the provisions of Section 4.

ARTICLE IX

THE NATIONAL EXECUTIVE COUNCIL

SECTION 1 – The National Executive Council shall be the policy making body of the national party hierarchy, and shall have general responsibility over the affairs of the Party in between National Members Assembly, subject to the provisions of this Charter and to the resolutions and other actions of the National Members Assembly.  Its responsibilities shall include:

1.1.      The issuance of Notice or Call to National Members Assembly;

1.2.      The conduct of the Party’s national election campaign;

1.3.      The formulation and dissemination of statements of Party policies;

1.4.      The execution of all other actions necessary to carry out the provisions of this Charter and the objectives of the Partidong Pandaigdigang Pilipino.

SECTION 2 – The National Executive Council shall be composed of:

2.1.      The elected/appointed National Chairperson, Vice Chairpersons, Secretary General, and National Finance Chair;

2.2.      The president  and vice president of all regional executive councils, including those based outside of the Philippines;

2.3.      The president/chairperson of the association of PPP city/municipal mayors;

2.4.      The president/chairperson of the association of PPP provincial governors;

2.5.      The heads of the Party in the Senate and House of Representatives;

2.6.      The president/chairperson of the association of Junior PPP members;

2.7.      The president/chairperson of the association of Women PPP members.

SECTION 3 – The National Executive Council in a meeting immediately following the meeting of the National Members Assembly shall elect the following officers of the Council:

3.1.  National Chairperson,

3.2.  Vice Chairperson for Luzon,

3.3.  Vice Chairperson for Visayas,

3.4.  Vice Chairperson for Mindanao,

3.5.  Vice Chairperson for National Capital Region,

3.6.  Vice Chairperson for Middle East,

3.7.  Vice Chairperson for Asia-Pacific,

3.8.  Vice Chairperson for Europe,

3.9.  Vice Chairperson for the Americas,

3.10.   Secretary General,

3.11.   National Finance Chairperson; and,

3.12.   Auditor

SECTION 4 – The National Executive Council in a meeting immediately following the meeting of the National Members Assembly shall appoint the members and following officers of the National Executive Board:

4.1.  President

4.2.  Executive Vice President

4.3.  Vice President for External Affairs

4.4.  Treasurer

4.5.  Public Relations Officer

4.6.  Government Relations Officer

SECTION 5 – Unless otherwise specified in this Charter, the National Executive Council shall, at a meeting called for the purpose, fill any vacant position enumerated in Sections 3 and 4 from among its members.

ARTICLE X

THE NATIONAL BOARD

SECTION 1 – The National Executive Board shall be elected by and serve at the pleasure of the National Executive Council. The size, composition, and term of office shall be determined by the National Executive Council, provided that the number of board members shall be no fewer than fifteen (15).

SECTION 2 – The National Executive Board shall include the following officers: A President, an Executive Vice President, and a Vice President for External Affairs, a Board Secretary, a Treasurer, and a National Chairperson for each of the national standing committees.

SECTION 3 – The National Board shall be the executive counterpart of the National Executive Council, and shall be responsible for the conduct of the affairs of the Party while the National Executive Council is not in session, subject to this Charter, the National Assembly, and the National Executive Council. It shall meet as often as needed, but not less than once every three months.

ARTICLE XI

THE NATIONAL CHAIRPERSON

SECTION 1 – The National Chairperson of the Party shall carry out the programs and policies approved by the National Assembly and the National Executive Council.

SECTION 2 – The National Chairperson, together with the vice chairpersons, the secretary general, national finance chair and Auditor, shall be elected by the National Executive Council at a meeting immediately following the National Assembly of Members, and whenever a vacancy occurs.

SECTION 3 – The Chairperson shall exercise impartiality and evenhandedness in the preparation and conduct of the Presidential nominating process, and shall ensure that the officers and staff of the National Executive Board do the same.

ARTICLE XII

THE NATIONAL OFFICERS

SECTION 1 – The National President

1.1.  The National President shall be Chief Executive Officer of the Party. He shall also be the Party’s Spokesperson unless he designates otherwise. He shall exercise all the powers and perform all the functions of the National Board and the National Executive Council when the urgency of the matter cannot wait for the action of the National Board and/or the National Executive Council. The exercise of such powers or the performance of such functions shall be reported to the National Executive Council at its next session. He may delegate any of his powers to any of the other Party officers.

1.2.  In case of any vacancy of the Party Presidency or permanent disability of the incumbent, the Executive Vice President shall assume the office for the remaining period of the term. Should the Executive Vice President for whatever reason fails to assume the Party Presidency, the National Executive Council shall meet not later than 15 days from the occurrence of the vacancy to elect a new National President who shall serve for the remaining period of the term. In the meantime, the Secretary General shall concurrently act as Party President.

SECTION 2 – The Executive Vice President

2.1.  The Executive Vice President shall exercise such powers and perform such functions as the National President may from time to time assign.

2.2.  In case of any vacancy in the position of Executive Vice President, the National Executive Council shall meet not later than 15 days from the occurrence of the vacancy to elect a new Executive Vice President who shall serve for the remaining period of the term. In the meantime, the Secretary General shall concurrently act as Executive Vice President.

SECTION 3 – The Vice President for External Affairs

3.1.  The Executive Vice President shall exercise such powers and perform such functions as the National President may from time to time assign.

 

 

SECTION 4 – The Secretary General

4.1.  The Secretary General shall be the Chief Administrative and Liaison Officer of the Party. He shall coordinate the activities of the Party at all levels. He shall be the custodian of all Party records and documents and shall be the official recorder of all minutes of meetings of the National Assembly, and the National Executive Council. He shall likewise oversee and direct the operations of the National Headquarters and other Party support organizations, in coordination with the National President and other national officers.

4.2.  Subject to approval by the National President, he shall appoint all subordinate officials and staff for his office. He shall fix their compensation and prescribe their duties and responsibilities.

SECTION 5 – The National Finance Chairperson

5.1.  The National Executive Council shall create a National Finance Organization or Committee which shall have general responsibility for the finances of the National Party.  This organization or committee shall raise funds to support the Party and shall advise and assist the local executive councils and candidates in securing funds for their purposes.

5.2.  The National Finance Chairperson shall head the National Finance Organization.

SECTION 6 – The Treasurer

6.1.  The Treasurer shall be the Chief Financial Officer of the Party. He shall be the custodian of Party funds and properties. He shall assist National Finance Committee in raising funds that shall be disbursed only upon authority of the National President.

6.2.  Subject to approval by the Party President, he shall appoint all subordinate officials and staff for his office. He shall fix their compensation and prescribe their duties and responsibilities.

SECTION 7 – The Auditor

7.1.The Auditor shall perform, or cause the conduct of, an internal audit of the Party officers and committees’ compliance to financial and management policies set forth in this Charter, the policy issuances of the National Assembly, National Executive Council and the National Board.

SECTION 8 – The Public Relations Officer

8.1.  The Public Relations Officer shall work closely with the Media and Public Information committee to achieve the Party’s strategies on promoting its image to the general public.

SECTION 9 – The Government Relations Officer

9.1.  The Government Relations Officer shall be responsible in all matters requiring coordination with various government agencies, diplomatic corps, and all other government organizations.

9.2.  He shall function as the NEC Chief Liaison Officer for all transactions with Liaison Officer for all transactions with any Government agencies and officials.

SECTION 10 – Disciplinary Actions

10.1.   Any officer of the Party may be removed or suspended on the following grounds:

10.1.1.  Commission of any act antagonistic to the Party objectives or inimical to its interests, or for violation of or deliberate failure to support any of its fundamental decisions;

10.1.2.  Membership in another political party, either by act or deed;

10.1.3.  Dishonesty, oppression or misconduct while in office, gross negligence, abuse of authority or dereliction of duty;

10.1.4.  Failure to attend two (2) consecutive Party meetings or at least ½ of the meetings duly convened within a calendar year of the appropriate committee or Party organization.

10.2.   Any officer of the Party may be subjected to disciplinary actions, including suspension from effective exercise of his Party rights for a period of one year or less for the same or less serious cause as may be established by the National Executive Council.

SECTION 8 – Procedure The National Executive Council, if so convened for the purpose, or acting upon a complaint for disciplinary action against any Party officer, may investigate the case and decide on the matter. The decision of the National Executive Council shall be final.

ARTICLE XIII

NATIONAL COMMITTEES

SECTION 1 – There shall be created a number of National Standing Committees, each to be composed of not more than five (5) members, namely:

SECTION 2 – Membership and Credentials Committee

2.1.  The committee shall be responsible for the overall recruitment and expansion program of the Party and shall act on recommendations for memberships submitted by the appropriate Party chapter.  

2.2.  The Committee shall receive and consider all challenges to the credentials of any member of the National Executive Council and National Board, provided that the challenge shall be filed within 30 days from the election or appointment of such member.

2.3.  The Committee shall determine the validity of the credentials of those elected to the National Executive Council and National Board, and decide all challenges to the seating of such member.

SECTION 3 – Political and Electoral Affairs Committee

3.1.  The committee shall oversee the Party’s overall electoral organizing program and strategies.

3.2.  It shall likewise be responsible for developing a candidate pool and the conduct of appropriate training for candidates and their supporters.

3.3.  It shall regularly conduct political analysis of national and local situations and undertake alliance-building and unified-front work with other political forces promoting similar goals, subject to guidelines established by the Party President.

SECTION 4 – Public Policy and Advocacy Committee

The committee shall be responsible for the public education and policy research program of the Party.

SECTION 5 – Media and Public Relations Committee

The committee shall have responsibility for the overall media exposure of the Party and for the maintenance of a good public image with the general population.

SECTION 6 – International Affairs Committee

6.1.  The Committee shall be responsible for the international liaison and political work with other Overseas Filipino parties and organizations in the world.

6.2.  It shall represent the Party in international meetings and conferences, whenever specifically designated by the Party President.

6.3.  It shall also monitor international developments that may have significance for the Party’s political work.

SECTION 7 – Finance Committee

7.1.  The Committee shall be composed of the National Finance Chair, the Treasurer, and at least five other members, who have training and experience in finance and management, elected or appointed by the National Executive Council.

7.2.  The Committee shall formulate an overall financial and resource-generation program and facilitate and oversee national fund-raising activities. It shall in full consultation with the National Chairperson review the budget of the Party on an ongoing basis, make periodic reports including an annual report to the National Executive Council.

SECTION 8 – All policies and regulations adopted by the Standing Committees shall be subject to the approval of the National Executive Board and National Executive Council and shall be disseminated to all Party chapters and committees.

ARTICLE XIV

THE REGIONAL EXECUTIVE COUNCIL

SECTION 1 – Subject to the supervision, control and direction of the National Executive Council and the National Board, the Regional Executive Council shall be the governing body of the Party in the Region and shall represent the Party before the people and the duly constituted authorities of the region regarding Party matters therein.

SECTION 2 – The Regional Executive Council shall be composed of the following:

2.1.  The member of the National Executive Council voting in that Region;

2.2.  Incumbent government regional executives who belong to the Party;

2.3.  Incumbent governors within the region who belong to the Party;

2.4.  The designated primary and alternate delegates from each provincial executive council in the region;

2.5.  One delegate from each of the Allied Sectoral Groups in the region, if so established.

SECTION 3 – Regional Executive Committee

Upon call of the National Party President, the Regional Executive Council shall elect from among its members an Executive Committee which shall be composed of a Chairman, a Vice Chairman, a Secretary, a Treasurer and such other officers as it may deem necessary. The Regional Executive Committee shall exercise the power of the Regional Executive Council when the latter is not in session.

ARTICLE XV

THE PROVINCIAL EXECUTIVE COUNCIL

SECTION 1 – Subject to the supervision, control and direction of the National Executive Council and the National Board, the Provincial Executive Council shall be the governing body of the Party in the Province and shall represent the Party before the people and the duly constituted authorities of the province regarding Party matters therein.

SECTION 2 – The Provincial Executive Council shall be composed of the following:

2.1.  The member of the National Executive Council voting in that Province;

2.2.  Incumbent members of the Provincial Board who belong to the Party;

2.3.  Incumbent City and Municipal Mayors within the Province who belong to the Party;

2.4.  The designated primary and alternate delegates from each municipal chapters in the province;

2.5.  One delegate from each of the Allied Sectoral Groups in the Province, if so established.

SECTION 3 – Provincial Executive Committee

Upon call of the National Party President, the Provincial Executive Council shall elect from among its members an Executive Committee which shall be composed of a Chairman, a Vice Chairman, a Secretary, a Treasurer and such other officers as it may deem necessary. The Provincial Executive Committee shall exercise the power of the Provincial Executive Council when the latter is not in session.

ARTICLE XVI

THE DISTRICT EXECUTIVE COUNCIL

SECTION 1 – Subject to the supervision, control and direction of the National Executive Council and the National Board and in coordination with the Provincial Executive Council, the District Executive Council shall be the governing body of the Party in the Congressional District and shall represent the Party before the people and the duly-constituted authorities in the District regarding Party matters.

SECTION 2 – The District Executive Council shall be composed of the following:

2.1.  The members of the National Executive Council and the Provincial Executive Council voting in the Congressional District;

2.2.  Incumbent City and Municipal Mayors voting in the District who belong to the Party;

2.3.  The designated primary and alternate delegates from each municipal chapters in the district;

2.4.  One delegate from each of the Allied Sectoral Groups in the District, if so established

SECTION 3 – When a Province comprises just one Legislative District, the Provincial Executive Council shall also be the District Executive Council, with the Provincial Chairperson acting as District Chairperson.

SECTION 4 – District Executive Committee

Upon the call of the Party President, the District Committee shall elect from among its members an Executive Committee composed of a Chairman, a Vice Chairman, a Secretary, a Treasurer and such other officers as it may consider necessary. It shall exercise the powers of the District Executive Council when the latter is not in session

ARTICLE XVII

THE MUNICIPAL CHAPTERS

SECTION 1 – A chapter of the Party shall be created in each municipality/city, or if possible at the Barangay level, where there are at least twenty five (25) party members. The Party chapters shall be the basic organizational units of the Party and shall therefore be the foundation of the Party hierarchy.

SECTION 2 – The Chapter general membership duly assembled shall be the highest governing body of the Chapter.

SECTION 3 – The Chapter members shall elect from among themselves the following members of the chapter’s Local Board: a chairperson, a chairperson each for the Membership and Credentials Committee, Political and Electoral Affairs Committee, Media and Public Relations Committee, Public Policy and Advocacy Committee and other committees that the chapter members may deem necessary.

SECTION 4 – The Local Board shall be the policy-making body of the Chapter and shall represent the Party before the people and duly constituted authorities of the Municipality or City on Party matters.

 

SECTION 5 – The Chapter members shall also elect from among themselves the Chapter’s President, Vice President, Secretary, Treasurer and Auditor. These officers shall compose the chapter’s Executive Committee. The Committee shall implement all the policies and programs approved by the Board and General Membership.

 

SECTION 6 – Chapters created outside the Philippines shall be governed by the provisions of Article VII Section 3 of this Code.

ARTICLE XVIII

CHOICE OF PARTY CANDIDATES FOR

ELECTIVE GOVERNMENT POSITIONS

SECTION 1 – The choice of Party candidates shall be within the exclusive jurisdiction of the appropriate Party structure, ensuring the broadest participation from the general Party membership when appropriate and feasible, as follows:

1.1.  Candidates for President, Vice President and Senator shall be chosen by the National Members Assembly and National Executive Council;

1.2.  Candidates for member of the House of Representatives shall be chosen by the appropriate District Executive Council  subject to the approval of the National Executive Council;

1.3.  Candidates for Local Chief Executives and Vice Chief Executives and members of Local Legislative Councils of Provinces, highly urbanized Cities and Chartered Cities shall be chosen by the respective Provincial Executive Council subject to the approval of the National Executive Council;

1.4.  Candidates for City/Municipal Councilor shall be chosen by the City or Municipal chapter, or by the Provincial Executive Council.

SECTION 2 – When the appropriate Executive Council or chapter has not been convened and constituted or has become inoperative the Party National Chairperson may, upon consultation with those affected, choose and nominate candidates for the area affected.

Appeals from decisions of an executive council shall be elevated to the next higher council.

SECTION 3 – Certificates of Nomination

3.1.  Certificates shall be issued by the Party National Chairperson or by the National President upon authorization by the former, for candidates for President, Vice President, Senators and members of the House of Representatives.

3.2.  The Party National Chairperson or by the National President may authorize in writing other Party officers to issue Certificates of Nomination to candidates for local elective offices.

3.3.  Certificates of Nomination as guest candidates may only be issued by the Party National Chairperson or by the National President, upon approval of the National Executive Council.

 

SECTION 3 – Qualifications and Disqualifications of Candidates 

Aside from the qualifications of candidates as provided by law, an official candidate of the Party must be a member in good standing of the Party at the time of consideration of his nomination by the appropriate Party executive council and has been a member of the Party for at least one (1) year from the date of the Election. However, the appropriate Party executive council may decide, by 2/3 vote of the members present, there being a quorum, to waive said requirement.

ARTICLE XIX

MISCELLANEOUS PROVISIONS

SECTION 1 – The President of the Philippines 

The President of the Philippines, when belonging to the Party, shall be the titular head of the Party.

SECTION 2 – Rules of Lower Party Organizations

Every organization or unit of the Party shall have the power to adopt, amend or repeal such local rules for its internal government as are not inconsistent with this Charter or with the rules, regulations, decisions or issuances of the National Assembly of Members, National Executive Council, and the National Board.

SECTION 3 – Records

Every organization or unit of the Party shall keep a roll of its members. In case of controversy, the records of its proceedings shall be considered final and binding when certified by the Party President or his duly authorized representative. It may place at its offices a signboard containing the name of the Party and the designation of the organization or unit.

SECTION 4 – Approval of Resolutions

Resolutions adopted by a Provincial, District, City, or Municipal Council shall be registered with the Offices of the General Secretary and shall be binding as of the date of registration

SECTION 5 – Suppletory Regulations

In the absence of specific provisions in this Charter the rules, regulations, decisions or issuances of the National Assembly, the National Executive Council, the National Board or the National Chairperson shall govern.

SECTION 6 – Incumbent Party Officers

All incumbent local Party officers, whether National, Regional, Provincial, District, City, or Municipal shall continue to serve as such until their successors shall have been duly chosen and qualified in accordance with this Charter.

SECTION 7- Quorum 

For the purpose of transacting business, the presence of ¼ of all members of any Party organization or unit shall constitute a quorum. However, the National Executive Council and the National Board may adopt its own rules respecting quorum.

 

SECTION 8 – Vacancies

Vacancies in the National Executive Council, the National Board, Provincial, District, City or Municipal Councils shall be filled by the corresponding councils or Party organization unless otherwise provided for in this Charter.

SECTION 9 – Party Officers

The officers and members of the National Executive Council, National Board and those of the Provincial, District, City or Municipal Councils are Party officers.

SECTION 10 – Caucuses of Elected Officials

Members of the Party who are elected to Congress shall constitute themselves into a caucus, with a Chairperson, for purposes of defining specific policies and approaches to be pursued in each Session of Congress. All Local Chief Executives shall likewise be convened by the Party into a caucus, which shall also elect its Chairperson, to determine common concerns for promoting local autonomy and good governance.

SECTION 11 – Oath of Office of Party Officers

Before entering upon the performance of their duties and assumption of their responsibilities, Party officers shall subscribe to the following Oath, the original of which shall be kept on file with the Office of the Secretary General:

I, _______________, having been elected _______________, of the Partidong Pandaigdigang Party, do hereby solemnly swear (or affirm) that I will well and faithfully discharge the duties of said office to the best of my ability; that I will uphold and defend the ideals and principles of the Partidong Pandaigdigang Pilipino as embodied in its Vision and Program of Government; that I will maintain my unswerving loyalty to the Partidong Pandaigdigang Pilipino, its Constitution, rules and decisions; and that I will serve the People and the Partidong Pandaigdigang Pilipino with utmost fidelity without any mental reservation whatsoever.

ARTICLE XX

RATIFICATION AND AMENDMENT OF THIS CHARTER

SECTION 1 – Ratification

Provisions of these Charter and By Laws shall be considered to have been ratified if 2/3 of the Founding Members present in a meeting called for the purpose approved these Charter and By Laws.

 

SECTION 2 – Amendments

This Charter may be amended by the vote of 2/3 of all members of the National Executive Council at a meeting called for the purpose by the National Chairperson, provided that the members of the National Executive Council present for said meeting are in quorum, which is defined as fifty percent plus one of the total membership of the National Executive Council.

ARTICLE XXI

PARLIAMENTARY AUTHORITY

SECTION 1 – On all matters not provided for under this Charter, the National Executive Council shall adopt the following documents and parliamentary authority:

1.1.  Standing Rules of Procedures for conducting meetings;

1.2.  Standing Orders of the Party;

1.3.  Compilation of Customs, Precedents and Procedures of the Party

ARTICLE XXII

EFFECTIVITY

This Charter and By Laws shall take effect upon adoption by the majority of the Founding members of the Partidong Pandaigdigang Pilipino.

The foregoing Charter and By Laws were approved unanimously by the Founding Members of the PPP at a Convention held for the purpose at its Headquarters, on this ______ day of May 2008.
